Review of Bylaws - Section 293 LGA 2002

The public are advised that at a meeting held on 1 May 2008 the Western Bay of Plenty District Council approved recommendations to review and update the Bylaws as required pursuant to Section 293 of the LGA 2002 and resolved to commence the Special Consultative Procedure as set out in Sections 83 and 86 of the Local Government Act 2002.

Summary of Proposal

The purpose of this proposal is to notify the public of a review and update of sections of the:

  • General Bylaw 2001 (9 Chapters)
  • Traffic and Parking Enforcement Bylaw 2002
  • Stock Droving Bylaw 1999
  • Water Supply System Bylaw 2000
  • Wastewater Drainage Bylaw 2001
  • Trade Wastes Bylaw 1993 which need to be reviewed under Section 293 of the LGA 2002 before 1 July 2008.
Proposed Changes
(all documents are in PDF file format) Submissions

The public are invited to make submissions on the proposed changes to the Bylaws affected under the provisions of Sec 293 of the LGA 2002. The period for submissions commences on Monday 5 May 2008 until Friday 6 June 2008 - except for the Trade Wastes Bylaw 2008 submission period (which under Section 148 of LGA 2002 is required to run for two months) commencing Monday 5 May 2008 until Monday 7 July 2008.



Draft Scheme for a Boundary Change between Western Bay of Plenty District and Tauranga City

The public are advised that at a meeting held on Wednesday 7 May 2008, the Western Bay of Plenty District Council / Tauranga City Council Joint Governance Committee approved a Plan to commence consultation on the Draft Reorganisational Boundary Change covering an area between State Highway 29 at Tauriko and State Highway 36, Pyes Pa West, and resolved to commence the Special Consultative Procedure as set out in Sections 83 and 87 of the Local Government Act 2002.

Summary of Proposal

The purpose of this proposal is to notify the public and affected persons of a boundary alteration to transfer an affected area as outlined in the proposed scheme plan from the Western Bay of Plenty District, and to include the affected area within the Tauranga City district as shown on the plan contained in the Schedule.

Submissions

If you wish to make a submission to this proposal, and would like to view a copy of the proposed boundary change, you may visit the Western Bay of Plenty District Council’s Head Office at Barkes Corner, Greerton or visit Council’s website at www.wbopdc.govt.nz.

The period for submission commences on Thursday 22 May 2008 for a period of two months closing on Monday 7 July 2008 at 5.00 pm.

The draft Kaimai Ward Reserves Management Plan Review is open for public consultation under the Reserves Act 1977 until 5.00pm, Monday 25 August 2008. The Plan provides information specific to the reserves in the Ward as well as generic reserve management policies.

    Proposed Private Plan Change 70 - Te Puke West Industrial

    The Western Bay of Plenty District Council has received a request by P&G West and Others for a Private Plan Change to the Western Bay of Plenty District Plan in respect to the following matters:

    1.The rezoning of land at Te Puke Quarry Road from Rural G to Industrial. The total area of land to be re-zoned is 72.1036 ha, providing approximately 45 ha of usable industrial land to cater for Te Puke’s future growth. The land in question is generally bounded by SH 2, Te Puke Quarry Road and Manoeka Road. The Plan change seeks to rezone the land for industrial use.

    2.Introducing changes, rules and controls governing development of the land concerned.

    3.The inclusion of a Structure Plan for the land to guide future development.

    4.Changes to District Plan Map G11.

    Related to the above is the stopping of Te Puke Quarry Road approximately 90m from the existing intersection with SH2. Persons affected directly by the road stopping will be notified separately in due course as part of the road stopping process.

    The first round of submissions for this Plan Change closed on Monday 11th February 2008. Further submissions closed on 28th March 2008.

    A public hearing will be held on the 4th and 5thJune 2008. All submitters will be given an opportunity to present their submissions. Council will then issue its decision including the reasons for accepting or rejecting submissions. Any person who has made a submission has the right to appeal the decision to the Environment Court.
